Transfer valuation and compensation expert witnesses

Evidence on what a player's registration was worth, and what a breach cost.

The start line on an athletics track

Many football disputes end in a number: the value of a player's registration, the compensation owed for a breach of contract, or the training compensation and solidarity due on a transfer. Valuation experts use transfer market data, comparable deals and the player's contract and performance profile to give a figure a tribunal can rely on.

This is one of the specialisms within our sports expert witness practice.

In sports, the difference between a strong case and a weak one often comes down to whether the expert truly understands the sector. Generalist opinion rarely survives scrutiny on specialist questions, and a tribunal gives little weight to evidence that misreads how sports actually works. We focus here precisely because the issues are technical, the stakes are high, and the wrong expert is an expensive mistake.

What these disputes actually turn on

When a player or club breaks a contract, FIFA's transfer rules provide for compensation that takes account of the law of the country, the specificity of sport and objective criteria such as the remaining value of the contract, fees paid and the time left to run. Each of those can be argued, and a valuation expert gives the tribunal a figure built on evidence rather than assertion.

The same skills apply to other disputes: whether a transfer fee was set far below market value to move money elsewhere, what training compensation or solidarity is due, and what a player was worth when a club was prevented from selling him.

What the expert will examine

  • Comparable transfers — deals for players of similar age, position, league and contract length.
  • The player's profile — minutes played, international caps, injury history and contract terms.
  • Market data and models — transfer databases and statistical valuation models, and their limits.
  • The contract — remaining term, salary, add-ons and sell-on clauses that move the value.

Online market-value estimates are a starting point, not evidence of value. A tribunal will expect the expert to explain the method and test it against real transfers.

What the CAS awards show

Valuation evidence appears in several awards on the CAS recent decisions page. In CAS 2025/A/11342 (Shpinev v FC Pari NN) an expert opinion was relied on to argue that a nominal transfer fee concealed the player's true value. The Olympique de Marseille, Watford and Gueye appeals (CAS 2022/A/8600) heard transfer market and legal experts. In CAS 2024/A/11103 (Al Gharafa v FCSB) the panel heard a quantum expert, and in CAS 2024/A/10310 (FC Barcelona v UEFA) the club relied on professors of financial economics and accounting.

Choosing the expert

The best valuation experts combine football market knowledge with a defensible method: they can explain why each comparable was chosen and why others were left out. For training compensation and solidarity, look for someone who knows FIFA's regulations and the club categorisation that drives the figures.

FAQ

Common questions

What does a transfer valuation and compensation expert witness do?

They give independent, objective opinion to a court or tribunal on transfer valuation and compensation issues within sports, with an overriding duty to the court under CPR Part 35. The opinion usually takes the form of a written report and, where required, oral evidence.

When should I instruct a transfer valuation and compensation expert?

As soon as the issues are clear. Early instruction helps you test the strengths and weaknesses of the case, scope the evidence proportionately and avoid a rushed report against a deadline.

How do you select experts for transfer valuation and compensation matters?

On substance: relevant qualifications, genuine sports experience and an understanding of an expert's duties in litigation and arbitration. Where an expert has limited experience of giving evidence, we say so.

Can online market values be used as evidence?

They can be a starting point, but a tribunal will expect an expert to explain the method, test it against comparable transfers and account for the player's contract, age and form.
